1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Untethr LLC ("Untethr", "we", "us") governing your use of the website at untethr.llc (the "Site"). By accessing or using the Site, you agree to these Terms, to our Acceptable Use Policy (which is incorporated into these Terms by reference), and to our Privacy Policy. If you do not agree, do not use the Site.

2. Our apps are governed separately

These Terms cover the Site only. Your use of any Untethr app is governed by the applicable End User License Agreement and, for apps obtained through the Apple App Store, by the Apple Media Services Terms and Conditions. Our apps are intended for adults 18 years of age or older.

3. Intellectual property

The Site and everything on it — including text, graphics, logos, the "Untethr" name and wordmark, app names, and software — are owned by Untethr LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for personal, non-commercial purposes. No other rights are granted.

If you believe content on the Site infringes your copyright or other rights, report it to contact@untethr.llc with enough detail for us to identify and assess the material, and we will respond promptly.

4. Acceptable use

You agree to use the Site only as permitted by these Terms and by our Acceptable Use Policy. We may suspend or terminate access for any violation.

5. Third-party links

The Site links to third-party sites and services (for example, the Apple App Store and Instagram). We do not control and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

6. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNTETHR LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify and hold harmless Untethr LLC and its members, managers, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.

9. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction.

10. Changes to these terms

We may update these Terms from time to time. The current version will always be posted on this page with its "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
